What Is PUWER 1998?
The Provision and Use of Work Equipment Regulations 1998 (PUWER) require employers to ensure that all work equipment is suitable for its purpose, maintained in a safe condition, and used only by trained personnel.
What Counts as Work Equipment?
PUWER applies to virtually all equipment used at work, including:
- Machinery and power tools
- Hand tools and lifting equipment
- Vehicles used in the workplace
- Office equipment and computers
- Ladders and stepladders
- Manufacturing and production equipment
Employer Duties Under PUWER
- Ensure equipment is suitable for the intended use
- Maintain equipment in good repair and efficient working order
- Provide adequate training for all users
- Ensure equipment has appropriate safeguards and protective devices
- Provide information, instruction and supervision
- Ensure equipment is inspected at suitable intervals
- Prevent use of equipment that poses a risk to safety
PUWER and Training
Under PUWER Regulation 9, employers must provide adequate training for all employees who use work equipment. This includes:
- Training on the safe use of the equipment
- Training on risks associated with the equipment
- Training on precautions to be taken
- Refresher training as appropriate
Enforcement and Penalties
PUWER is enforced by the HSE and local authorities. Non-compliance can result in enforcement notices, prosecution, unlimited fines, and imprisonment for serious breaches.
