Weekly Legislation & Compliance Update: 13 October 2026
Hello everyone, Mark here from Livius Training. I’m writing this from my desk in Boroughbridge, and I wanted to share a sobering reminder of why we do what we do. Just this past week, on 5th October 2026, the HSE reported a prosecution involving a worker who suffered severe burns to her hands, face, and legs while disposing of pyrotechnic waste. The company involved, GMK Limited, failed to carry out a suitable risk assessment and didn't provide the necessary personal protective equipment (PPE). To make matters worse, they were also found to be in breach of their explosive licence.
It’s a stark reminder that health and safety isn't just paperwork—it’s about ensuring that every single person who walks through your doors goes home in the same condition they arrived. Whether you are dealing with hazardous substances, manual handling, or high-risk machinery, the law is clear: the responsibility sits with the employer to identify the risks and provide the right protection.
This case highlights a broader trend we’ve seen throughout 2026. The HSE is not just looking at the obvious hazards; they are scrutinising the systems behind the scenes, including how you manage your occupational health providers and your COSHH assessments. If you haven't reviewed your risk assessments in the last six months, now is the time to do it.
What should you do this week?
- → Review your high-risk activities: Don't just rely on old templates. Walk the floor, talk to your team, and ensure your risk assessments actually reflect the work being done today, not how it was done three years ago.
- → Check your PPE provision: Is the equipment you provide actually suitable for the specific task? Ensure it is maintained, stored correctly, and that your staff are trained on how to use it properly.
- → Audit your training records: Are your staff certifications up to date? If you’re unsure, it’s better to refresh that training now than to face an inspector later.
